Terms and Conditions

These Terms and Conditions govern the supply of goods and services by HE Glazing ("we", "us", "our") to you ("the customer", "you"). By accepting a quotation, placing an order, or allowing work to commence, you agree to be bound by these Terms and Conditions.

2. Definitions
- "Goods" means all products supplied by us, including but not limited to windows, doors, frames, glazing units, and associated materials.
- "Services" means all installation, fitting, removal, surveying, and related works carried out by us.
- "Contract" means the agreement between you and us for the supply of Goods and/or Services.
3. Quotations and Estimates
3.1 All quotations are valid for 30 days unless stated otherwise.
3.2 Quotations are based on information available at the time of survey. Any additional work identified after commencement may be charged separately.
3.3 Prices may be subject to change if there are variations in specification, measurements, access conditions, or unforeseen structural issues.
4. Orders and Acceptance
4.1 A contract is formed once you accept our quotation in writing (including email) or pay a deposit.
4.2 Any amendments to an order must be agreed in writing. Changes may affect pricing and completion times.
4.3 We reserve the right to refuse or cancel orders in exceptional circumstances, including product unavailability or incorrect pricing.
5. Deposits, Payment, and Contract Formation
5.1 A deposit of 50% of the total quoted price is required before Goods are ordered or Services commence.
5.2 Payment of the 50% deposit constitutes acceptance of our quotation, entry into a legally binding contract, and agreement to these Terms and Conditions in full.
5.3 The balance of the contract price must be paid in full immediately upon completion of the works unless otherwise agreed in writing.
5.4 Late payments may be subject to interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.
5.5 Retention of Title: All Goods and materials supplied remain the property of HE Glazing until full and final payment has been received. We reserve the right to recover unpaid Goods where legally permissible.
6. Installation Timescales and Additional Labour
6.1 Installation dates and durations are estimates based on the scope of works agreed at the time of quotation.
6.2 The quoted price is based on a fixed number of agreed installation days.
6.3 If additional days are required at the customer’s request or due to customer‑caused delays, changes, or access restrictions, additional labour costs will be chargeable at our prevailing daily rate of £250 for our lead glazier, of £400 if the job requires a team of two.
6.4 Delays caused by events outside our control (including weather, supplier delays, or structural issues) will not constitute a breach of contract.
6.5 You are responsible for ensuring clear access to the property and work areas for the agreed duration of the works.
7. Customer Responsibilities
7.1 You must ensure that all necessary permissions, including planning permission and building regulations approval (unless otherwise agreed), are in place.
7.2 You must remove or protect furniture, fixtures, and personal belongings in work areas.
7.3 We will not be responsible for damage to hidden pipes, cables, or structures not reasonably identifiable prior to work.
8. Cancellation, Bespoke Goods, and Refunds
8.1 If you are a consumer and the contract is agreed off‑premises or at a distance, you may have the right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to the exclusions below.
8.2 All Goods supplied by us are made to measure and bespoke in nature. Where a deposit has been paid and manufacturing or ordering of materials has commenced, your right to cancel may be restricted.
8.3 If you choose to cancel the contract after paying the deposit, your deposit will be refunded less the cost of any materials already ordered, manufactured, or committed, including any non‑refundable supplier costs.
8.4 Where the value of materials exceeds the deposit paid, you may be liable for the outstanding balance relating to those materials.
8.5 Cancellation must be provided in writing.
9. Defects, Warranty, and Guarantees
9.1 We provide workmanship guarantees in accordance with industry standards.
9.2 Manufacturer warranties apply to Goods supplied and will be passed on where applicable.
9.3 Any defects must be reported to us within a reasonable time.
9.4 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
10. Damage and Making Good
10.1 We will take reasonable care when carrying out work; however, some disturbance to plaster, brickwork, tiles, or decorations may occur.
10.2 Making good is limited to a practical finish and does not include full redecoration unless expressly agreed.
11. Limitation of Liability
11.1 We are not liable for:
- Indirect or consequential losses
- Loss of profits or business
- Delays beyond our reasonable control
11.2 Our total liability shall not exceed the total contract value, except where prohibited by law.
11.3 Nothing limits liability for death or personal injury caused by negligence.
12. Force Majeure
We shall not be liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, or supply chain disruption.
13. Complaints
13.1 Complaints should be raised in writing as soon as possible.
13.2 We aim to resolve complaints promptly and fairly.
14. Privacy and Data Protection
We process personal data in accordance with UK data protection legislation. Please refer to our Privacy Policy on our website for details.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
16. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede any prior discussions or representations.
